eLayaway Unauthorized Transaction Policy
This policy applies to unauthorized and/or erroneous transactions involving your eLayaway account and/or the registered bank account on file.
By enrolling in our service and becoming a member, you accept this policy in conjunction with the Member Terms & Conditions. eLayaway may amend this policy at any time by posting a revised version on its website. The revised version will be effective at the time eLayaway posts it. In addition, if the revised version includes a substantial* change, eLayaway will provide the member with 30 days prior notice by posting notice of the change on the website. eLayaway last modified this Unauthorized Transaction Policy on December 29, 2010.
*eLayaway defines a substantial change as anything affecting the terms of this agreement that reduce or increase your responsibilities.
Notification Terms
You should immediately notify eLayaway in the event that you believe any of the following has occurred:
- There has been an unauthorized transaction or unauthorized access to your eLayaway Account;
- There is an error in your account history or the purchase confirmation sent to you via email;
- Your password or email account has been compromised;
- Your registered bank account has been compromised; and/or
- You need more information about a transaction, a purchase confirmation, or the policies and procedures listed.
Notification must be provided to eLayaway within sixty (60) days after any unauthorized transaction and/or error. eLayaway reserves the right to release liability if the disputed claim is not presented to us in a timely fashion as described above.
eLayaway encourages its members to log into their eLayaway Account often to ensure that there has not been an unauthorized transaction or error. eLayaway will send an email to the email address provided in order to notify you of each transaction from your eLayaway Account. We recommend that you review these purchase confirmations to ensure that each transaction is accurate and authorized.
In Case of an Unauthorized or Erroneous Transactions
An unauthorized transaction is a type of error that occurs when money is taken from your registered bank account without your authorization and that did not benefit you. For example, if someone steals your banking information, uses this information to set up a fraudulent eLayaway Account and then sets up layaways, an unauthorized transaction has occurred.
In addition, other errors occur when money is either incorrectly taken from your bank account or incorrectly placed in your bank account, or when transactions are incorrectly recorded in your eLayaway Account.
If you believe that the transaction history in your eLayaway Account, any confirmation for a transaction, and/or any transaction initiated through eLayaway or a participating Merchant is in error or is unauthorized; or if you need any information regarding your eLayaway Account or transactions to determine whether an error exists, you should contact us as soon as possible by telephone at (877) 352-9292 from M-F 9AM-8PM EST, or by using the Contact Us page, or writing to us at:

When you contact us about an error or an unauthorized transaction, you may be asked to provide us with the following information:
- Your name, address, telephone number, and the e-mail address associated with your eLayaway Account;
- A description of the error or transaction that you are unsure about, and a clear explanation of why you believe it is an error or why you need more information;
- The dollar amount of the suspected error;
- The transaction date and associated transaction identification number from your eLayaway Account history and bank account statement;
- A telephone number at which you can be reached in case we need further information;
- The name and telephone number of your bank if the error relates to a debit from or a credit to your bank account using your eLayaway Account; and
- A police report to substantiate any fraudulent activity regarding a stolen bank account.
PLEASE NOTE: ELAYAWAY WILL NEVER ASK FOR YOUR PASSWORD INFORMATION.
If you provide us with this information over the phone, we may require that you send us your grievance or question in writing within ten (10) Business Days of your inquiry. If we ask you to put your grievance or question in writing and we do not receive a response from you within ten (10) Business Days, we will consider the inquiry dismissed.
Resolution Process
Once you notify us of any suspected unauthorized activity or error, or we learn of one otherwise, we will do the following:
- Conduct an investigation to determine whether there has been an unauthorized transaction or error.
- We will attempt to determine whether an error or unauthorized transaction occurred within ten (10) Business Days after we hear from you. If more time is needed to process your claim, we may take up to thirty (30) days to investigate your grievance or question. Notification will be given to you if more time is needed.
- We will tell you the results of our investigation within three (3) Business Days after its completion.
-If we determine that there was no error and/or unauthorized transactions, we will send you a written explanation via email of our justification.
-In the event that we do find issues of error and/or instances of unauthorized transactions, we will promptly correct the error by appropriately crediting or debiting the bank account on file. If a credit is issued to your account, the credit will take 2-3 business days from the date of determination to process.
If during our investigation it is discovered that more money is owed on the part of the registered eLayaway Member or Merchant, eLayaway reserves the right to pull such funds from the registered bank account on file, without notice. The Member or Merchant may request any documentation used by eLayaway during the investigation process.
eLayaway Processing Errors.
eLayaway will take the appropriate actions needed to rectify any error that we discover or that is brought to our attention. If the error resulted in you receiving less than the correct amount to which you were entitled, eLayaway will credit your bank account for the difference. If the error resulted in you receiving more than the correct amount to which you were entitled, eLayaway will debit the extra funds from your registered bank account.
eLayaway will NOT assume liability for any losses or damages incurred as a direct result of any error that is related to an intended layaway or membership fee, or in the event that the incorrect amount was debited.
eLayaway reserves the right to waive liability if it is determined that (a) through no fault of ours, you did not have enough available funds to complete the transaction, (b) our system was not working properly and you knew about the breakdown when you started the transaction, or (c) circumstances beyond our control (such as fire, flood or loss of Internet connection) prevented the transaction, despite our reasonable precautions, (d) notification was not given to eLayaway in a timely fashion as per our Notification Terms (above), (e) other exceptions allowed by law or provided in our agreement with you.
